Counter-Notice Procedure
If a merchant or user believes their content was removed in error, they may submit a counter-notice to Contact Page, including:
- Identification of the removed content and its location before removal.
- A statement under penalty of perjury that the content was removed or disabled as a result of a mistake or misidentification.
- Their contact information and consent to the jurisdiction of the supplier’s country for dispute resolution.
Mallria will review counter-notices and may restore content if the claim is deemed invalid, subject to applicable laws.
Repeat Infringers
Mallria reserves the right to terminate accounts of users or merchants who repeatedly violate intellectual property rights or platform policies, at our sole discretion.
Dispute Resolution and Jurisdiction
In cases of alleged infringement, disputes will be referred to the jurisdiction of the supplier’s or merchant’s country of operation for resolution. Mallria is not a party to such disputes and will not be held liable for their outcome. Users and merchants agree that any legal action or claim must be pursued against the responsible party (e.g., the merchant or content provider) and not Mallria, unless expressly required by law.
Limitations of Liability
Due to the volume of content uploaded to our platform, Mallria cannot pre-screen, monitor, or manually review every post, comment, or product listing. As such, instances of non-compliance or infringement may occur without our knowledge or control. Mallria is not liable for any losses, damages, or claims arising from such occurrences, including but not limited to intellectual property violations, defective products, or inaccurate content.
